These Terms and Conditions apply to the use of the website (“Site”) http://www.LifeCodeArt.com.  Any person visiting the Site is referred to as a user (“User”). Users who decide to purchase Goods and Services become a customer (“Customer”).

The copyright in all materials on the Site, trademarks (whether registered or not), names, logos and the like, are the property of the Site owner. Nothing contained on this Site should be construed as granting any license or right to use or reproduce, in whole or in part, any content without the prior written permission of the Site owner.

The Terms and Conditions of Use are subject to revision without notice. Any such revisions will be binding and effective immediately upon posting of the revised Terms and Conditions of Use on the Site. Your continued use of the Site constitutes agreement to any revision of Terms and Conditions of Use.  Therefore, we advise you to check the conditions for changes periodically.

User License

Users of the Site may browse only the publicly accessible part of the Site.  Users may not access or attempt to access areas of the Site not available to the public.

We recommend viewing the Site on correctly functioning and color calibrated monitors to see the accurate colors of the artworks and artwork representations. Uncalibrated and older monitors may display colors that vary significantly.

The Services are not intended for business or commercial purposes and may not be copied or sold.

This Agreement shall be governed in all respects by the laws of the United States of America and by the laws of the State of New York.  Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in New York, as applicable, for any matter arising out of, or relating to, this Agreement, except that in actions seeking to enforce any order or any judgment of such federal or state courts located in New York, such personal jurisdiction shall be nonexclusive.

The Site is updated and improved on an ongoing basis. We reserve the right to change or remove, temporarily or permanently, the Site or any part of it without notice and you confirm that we shall not be liable to you for any such change or removal; and changes to these Terms and Conditions of Use may be made at any time and your use of the Site, or the purchase of Goods and Services, are subject to any such changes. You agree to check to see if any changes have been made to the Terms and Conditions of Use each time you visit the Site or purchase Goods and Services from it.

Limitation Of Liability

Users and Customers agree that our entire liability, and your exclusive remedy, with respect to any Goods and Services provided under the Terms and Conditions of Use and any breach of the Terms and Conditions of Use is solely limited to the amount you paid for such Goods and Services. We shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use any of its services or for the cost of procurement of substitute services.

Purchasing Goods And Services

Users of the Site who order products become Customers, and enter into an agreement with us requesting the manufacture of artwork in the style, color palette, size and material selected.

While most orders are satisfied within a week, from the date of order, there can be times when forces beyond our control delay delivery.  In such an event we are not liable to pay any compensation for any delays. 

Any changes or additions requested by the Customer may be subject to additional charges.  Any changes or additions due to errors on our part are not chargeable.

Placing an order constitutes a contract and you are assumed to have read and understood these Terms and Conditions of Use.
